Section titled “Please Share Anything that Will Help Prepare for Our Meeting”In December 2022 my wife Sarah was skiing in Park City, UT on a sunny, high-visibility day (we have pictures) when a snowboarder called Easton Simpson jumped at high speed over a blind crest and collided with her.
The collision was so significant it sheared the binding off her ski, and caused her to be taken to hospital for scans and subsequent physical therapy. At the time, my brother-in-law (a lawyer from London) was skiing with her and he believes Mr Simpson was skiing recklessly in not being able to control his course and speed to prevent a collision.
The group of snowboarders that Mr Simpson was part of was also observed just moments before by a Park City ski instructor who subsequently sent Sarah the following text message:
“It is just unbelievable for me. I have been teaching for 32 years and never seen such reckless abandon for safety on this mountain! […] He should be paying for your medical bills. I would contact ski patrol tomorrow and have somebody look at that report.. If you need a witness I saw them.. reckless out of control snowboarding straight lining it to get air off that hump”
After the event I contacted Mr Easton, explained why I thought the incident was caused by his negligent behavior, and asked him to cover the medical and property bills we’d incurred. He refused: first he said he’d spoken to an attorney and had been advised not to pay, then he said he didn’t have insurance or assets, then he said it was Sarah’s fault, then he said the resort should have insurance, then he said she shouldn’t have been under a blind crest and “there were also no slow signs put up”.
I’d now like to take legal action to reclaim the money we’ve liable for (between $10-15k).
I understand this type of thing can be difficult to prove, but given the 3rd party witness, the communications we’ve had from Mr Easton, and the pictures we have of the good weather conditions I feel I have to try something to hold him accountable.
